Public Offer

This document is a public offer by the owner of formo.website (the "Operator") addressed to any person with legal capacity (the "Customer") who accepts this offer to use the Formo Service on the terms below.

1. Subject

The Operator grants the Customer access to the Formo online form-builder Service at formo.website, in the scope of the chosen plan.

2. Acceptance

The offer is accepted by any of the following:

  • registering an account in the Service,
  • paying for a chosen plan.

Upon acceptance the offer becomes a binding service agreement between the Operator and the Customer.

3. Plans and payment

  • Current plans are published on the pricing page.
  • Payment is made in advance via the chosen payment provider.
  • Services are deemed properly rendered if the Customer does not submit a written objection within 5 business days after the billing period ends.

4. Refunds

  • Within 14 days after the first payment a consumer Customer may withdraw and request a refund minus actually incurred expenses.
  • After 14 days, early termination refunds are granted pro rata for the unused period at the Operator's discretion.
  • Refund requests: post@formo.website with the account id.

5. Rights and obligations

The Operator undertakes to:

  • keep the Service available during the paid period,
  • protect Customer data per the Privacy Policy,
  • give at least 14 days' notice of material changes.

The Customer undertakes to:

  • use the Service per the Terms of Service,
  • pay on time,
  • not share access beyond what the plan allows.

6. Liability

Each party is liable under applicable law. The Operator's aggregate liability is capped at the amount paid by the Customer in the last 12 months. The Operator is not liable for lost profits or indirect damages.

7. Force majeure

Parties are released from liability for non-performance caused by force majeure, including outages at infrastructure providers.

8. Changes

The Operator may amend the offer by publishing a new version on this page at least 14 days in advance. Continued use after that date constitutes acceptance.

9. Governing law

Russian law applies for Russian residents; local consumer law applies for EU/EEA residents.
