Terms of Service

These Terms govern the relationship between the owner of formo.website (the "Operator", "we") and any person using the Service (the "User", "you").

1. Acceptance

By registering or using the Service you confirm that you have read, understood, and accept these Terms, the Privacy Policy, and the Cookie Policy.

2. The Service

Formo is an online builder for forms, surveys, and quizzes. It lets you:

  • build forms from templates or from scratch,
  • publish them at a unique URL,
  • collect and analyse responses,
  • use an AI assistant to draft questions.

3. Account

  • Some features require an account (email or Google).
  • You agree to provide accurate information and keep it up to date.
  • You are responsible for keeping your credentials secure and for all activity under your account.
  • Sharing access with third parties is prohibited unless the Service explicitly supports it.

4. Your content

  • You retain ownership of forms and responses you create.
  • You grant us a non-exclusive licence to store, display, and technically process the content as needed to operate the Service.
  • You warrant that you hold all necessary rights and consents for the content and for collecting personal data from respondents.
  • You are the data controller for personal data collected through your forms; we act as processor on your instructions.

5. Prohibited use

You must not use the Service to:

  • collect data of children under 16 without parental consent,
  • collect biometric, medical, or financial data without a valid legal basis,
  • conduct fraud, phishing, spam, or distribute malware,
  • promote hatred, infringe third-party rights, or violate any law,
  • circumvent technical restrictions or attempt to disrupt the Service.

We may suspend the account and remove content for breaches.

6. Plans and payment

  • Basic features are free.
  • Paid plans (if any) are described on the pricing page; terms of payment and refunds are in the public offer.
  • We may change prices; we notify paying users at least 30 days in advance.

7. Availability

We aim for high availability but do not guarantee uninterrupted service. Outages and maintenance may occur. We try to give advance notice of planned downtime.

8. Intellectual property

All rights to the Service, its design, code, brand, and templates (excluding user content) belong to the Operator. You may use them only within the functionality provided.

9. Limitation of liability

To the extent permitted by applicable law, we are not liable for:

  • lost profits, indirect or incidental damages,
  • data that cannot be restored from the latest backup,
  • third-party actions including infrastructure and payment providers,
  • the content of user forms and responses.

Our aggregate liability is capped at the amount you paid to us in the last 12 months.

10. Termination

  • You may delete your account at any time in settings.
  • We may suspend or terminate access for breach, by law, or upon Service discontinuation (with at least 30 days' notice absent breach).

11. Changes

We may update these Terms. Material changes are posted at least 14 days before they take effect. Continued use after that date constitutes acceptance.

12. Governing law and disputes

For users in Russia, Russian law applies; disputes go to the courts at the Operator's location. For users in the EU/EEA, your local consumer-protection rules apply.
